SPOX sells pre-owned, second-hand, vintage, and used bags and cameras. ALL ITEMS ARE SOLD "AS IS" AND "WITH ALL FAULTS" except where explicitly stated otherwise in a product listing. We make no express or implied warranties, including but not limited to:

  • Implied warranty of merchantability (fitness for ordinary use)

  • Implied warranty of fitness for a particular purpose (e.g., waterproofness of a vintage bag, accuracy of a film camera's light meter)

  • Warranty of non-infringement

  • Any warranty that a used camera will function without repair or that a used bag will have no loose stitching

Product descriptions and photographs are provided for informational purposes only and do not constitute warranties. Minor cosmetic imperfections, signs of age, patina, dust in optics, or worn zippers are normal for used items and are not considered defects. For our limited 7-day inspection period, please refer to our Return & Refund Policy.

5. Limitation of Liability
To the maximum extent permitted by South Carolina law (S.C. Code Ann. § 36-2-719), SPOX and its owners, employees, affiliates, and agents shall not be liable for any:

  • Consequential, incidental, indirect, exemplary, or special damages

  • Lost profits, lost savings, or loss of data

  • Damages arising from inability to use a purchased camera or bag

  • Damages from third-party claims (e.g., you lend the camera to a friend who drops it)

Our total aggregate liability to any customer for any claim arising from a purchase shall not exceed the actual price paid for the specific item giving rise to the claim. Some states do not allow the exclusion of incidental or consequential damages, so this limitation may not apply to you. This does not affect your statutory rights that cannot be waived by contract.

6. Copyright & Intellectual Property Notice
All content on the SPOX website (spox.store), including but not limited to: product photographs (of used bags and cameras), written descriptions, logos, the "SPOX" name and wordmark, website code, and graphic design elements, is the exclusive property of SPOX or its content licensors. Unauthorized reproduction, distribution, modification, public display, or scraping of any content for commercial purposes (including reselling our photos on other marketplaces) is strictly prohibited and will result in legal action under the United States Copyright Act (17 U.S.C. § 101 et seq.).
Permitted use: You may share links to SPOX products on social media with proper attribution. You may not download our product photos to resell your own items using our images.

7. Governing Law & Jurisdiction
This Legal Notice, together with our Terms of Service, Return & Refund Policy, Privacy Policy, and Shipping Policy, shall be governed by and construed in accordance with the laws of the State of South Carolina and applicable federal laws of the United States of America, without regard to conflict of law principles that would apply another jurisdiction's laws.
Venue: Any legal action or proceeding arising from your purchase from or interaction with SPOX shall be brought exclusively in the courts of Charleston County, South Carolina, or the United States District Court for the District of South Carolina (Charleston Division). You irrevocably consent to personal jurisdiction in South Carolina and waive any objection based on forum non conveniens.

8. Dispute Resolution & Arbitration Clause (Read Carefully)
Except for small claims court claims under $500, any dispute, claim, or controversy arising out of or relating to your purchase from SPOX or these policies shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

**Costs:** SPOX will pay all arbitration filing fees for claims under $10,000.
No class actions: You agree to arbitrate only on an individual basis – class arbitrations, class actions, and representative actions are prohibited.

9. Age Restriction
SPOX sells products (used cameras and bags) intended for adult collectors, photographers, and fashion enthusiasts. You must be at least 18 years old to place an order. By completing a purchase, you represent and warrant that you are 18 or older. If we discover that a person under 18 has placed an order, we will cancel it immediately and delete all associated data per our Privacy Policy.

10. Force Majeure
SPOX shall not be held liable for any delay or failure to perform its obligations (including shipping, handling, or responding to inquiries) if such delay or failure arises from causes beyond our reasonable control, including but not limited to: natural disasters (hurricanes, floods, earthquakes), acts of war or terrorism, pandemics, government orders, postal strikes, or carrier (UPS/USPS/FedEx) service disruptions. In the event of force majeure, we will make reasonable efforts to notify affected customers via email to Contact@spox.store.

11. Severability
If any provision of this Legal Notice is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is impossible, it shall be severed. The remaining provisions shall continue in full force and effect.

12. Entire Agreement & Modifications
This Legal Notice, together with our Terms of Service, Return & Refund Policy, Privacy Policy, and Shipping Policy, constitutes the entire agreement between you and SPOX. No oral or written representation outside these documents is binding. SPOX reserves the right to modify this Legal Notice at any time. Changes become effective immediately upon posting to spox.store. Your continued use of our website after changes constitutes acceptance. For material changes, we will notify active customers via email to Contact@spox.store.

14. Consumer Protection Notice (For EU & UK Customers)
If you are a consumer located in the European Union or United Kingdom, nothing in this Legal Notice limits your statutory rights under applicable consumer protection laws, including the right to withdraw from a distance contract within 14 days (except that SPOX pre-owned items are explicitly excluded from this right as "second-hand goods subject to rapid fluctuations in availability" – see our Return & Refund Policy).
