1. Agreement to Terms
By accessing or using the SPOX website (spox.store), placing an order, or contacting our customer support, you agree to be bound by these Terms of Service, our Return & Refund Policy, and our Privacy Policy. If you do not agree with any part of these terms, you may not purchase from SPOX. These terms apply to all users: browsers, vendors, customers, and browsers of used bags and cameras.

2. Eligibility & Account Responsibility
You must be at least 18 years old to purchase from SPOX. By placing an order, you represent that all information you provide (name, billing address, shipping address, payment details) is accurate and complete. You are responsible for maintaining the confidentiality of your Shopify account password and for all activities that occur under your account. SPOX reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion (e.g., suspected fraud, repeated returns).

3. Products – Used Bags & Cameras (As-Described Condition)
SPOX sells pre-owned, second-hand, vintage, and used items. You acknowledge that used bags may have signs of wear (scratches, patina, softening leather, worn corners, odor from previous use) and used cameras may have cosmetic imperfections, slight dust in the viewfinder, or non-original replacement parts. Each product listing includes written descriptions and photographs. The condition is stated as "Good," "Very Good," "Excellent," or "As-Is/For Parts." By purchasing, you agree that minor variations from photos (lighting, angle) do not constitute a material misrepresentation. We do not offer warranties – all used items are sold "AS IS" except where prohibited by law. For defects not disclosed, refer to our Return & Refund Policy (7-day inspection period).

4. Orders, Pricing, and Payment
All prices listed on SPOX are in US Dollars (USD). We reserve the right to change prices or discontinue items at any time without notice. Taxes, customs duties, or import fees (for international orders) are your responsibility unless otherwise stated. After placing an order, you will receive an email confirmation to Contact@spox.store. We reserve the right to cancel any order due to: pricing errors, suspected fraud, out-of-stock items (rare with used inventory), or violation of these terms. Payment methods accepted: major credit cards (Visa, Mastercard, Amex, Discover), PayPal, and Shopify Payments. Your payment information is processed securely per our Privacy Policy.

5. Shipping, Delivery, and Risk of Loss
SPOX ships worldwide via UPS, USPS, or FedEx (Fast Shipping option available). Standard Shipping (1-3 business days) is free. Handling time is 1-2 business days from order confirmation. Delivery estimates are not guaranteed – delays by carriers do not qualify for refunds. Title and risk of loss for used bags and cameras pass to you upon delivery to the carrier (UPS/USPS/FedEx). This means: if a package is lost or damaged in transit, SPOX will assist with a carrier claim per our Return & Refund Policy (Section 7), but we are not responsible for carrier-caused delays or loss after handoff. You must provide a correct shipping address. If a package is returned to us due to an incorrect address, refusal, or unclaimed status, you will be charged a $12 re-shipping fee. If not claimed within 14 days, the order is considered donated with no refund.

6. Returns, Refunds, and Restocking Fees
Returns are governed exclusively by our Return & Refund Policy (available in your order confirmation and on our website). In summary: you have 7 days from delivery to inspect your used bag or camera. Unauthorized returns are refused. Approved returns are subject to a 15% restocking fee and deduction of original outbound shipping costs (even if you received free Standard Shipping). "Change of mind" is not a valid reason for return. By placing an order, you explicitly agree to these return terms. Any chargeback or PayPal dispute filed without following our return process will be contested with full order details, tracking, and this policy, likely resulting in a denial of your dispute.

7. Prohibited Conduct
When using SPOX, you agree NOT to:

  • Resell our used bags or cameras on third-party platforms without disclosing that you are a reseller (bulk purchasing restrictions apply).

  • Harass our support team (Monday-Sunday, 8am-11:30pm) with excessive or abusive messages.

  • Falsify return claims (e.g., damaging an item after delivery to claim a refund).

  • Use our website for any illegal activity, including money laundering or purchasing stolen goods (SPOX verifies our inventory sources).

  • Upload malware, viruses, or other harmful code to spox.store.
    Violation of these terms may result in a permanent ban from SPOX and legal action if damages occur.

8. Intellectual Property
All content on SPOX – including product photos (of used bags and cameras), descriptions, logos, the name "SPOX", and website design – is our property or licensed to us. You may not copy, reproduce, distribute, or create derivative works without our written permission. You retain ownership of photos you send to Contact@spox.store for return requests, but you grant SPOX a non-exclusive license to use those photos for dispute resolution and fraud prevention.

9. Limitation of Liability
To the maximum extent permitted by law, SPOX and our owners, employees, or affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your purchase or use of a used bag or camera. Our total liability to you for any claim (including defective items, shipping delays, or misdescription) shall not exceed the price you paid for the specific item giving rise to the claim. Some states do not allow the exclusion of consequential damages, so this limitation may not apply to you. This does not affect your statutory rights where you cannot waive them.

10. Disclaimer of Warranties
SPOX provides the website and all products "AS IS" and "AS AVAILABLE". We make no express or implied warranties, including but not limited to: implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that your use of the site will be uninterrupted or error-free. For used cameras: we do not guarantee light meter accuracy, shutter speed precision, or water resistance. For used bags: we do not guarantee structural strength of aged leather. If a manufacturer's original warranty remains (rare for used items), that warranty is between you and the manufacturer – SPOX does not act as a warranty administrator.

11. Indemnification
You agree to indemnify, defend, and hold harmless SPOX, our employees, and our affiliates from any claim, loss, liability, damage, or expense (including reasonable attorney's fees) arising from: your violation of these Terms of Service, your misuse of a purchased item, your return shipping damages, or your violation of any law or third-party right.

12. Governing Law & Dispute Resolution
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to conflict of law principles. Any dispute arising from your purchase from SPOX shall first be attempted to be resolved informally by contacting Contact@spox.store (we respond within 2 hours on average, 7 days a week). If a dispute cannot be resolved within 30 days, you agree to submit to binding arbitration in Charleston County, South Carolina, rather than filing a lawsuit in court. Class actions and jury trials are waived. Small claims court disputes under $500 are exempt from this arbitration clause.

13. Severability & No Waiver
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14. Changes to Terms of Service
SPOX may update these Terms of Service from time to time (e.g., new shipping partners, legal requirements). The "Last updated" date at the top will reflect changes. For material changes (e.g., arbitration terms, liability limitations), we will notify you via email to Contact@spox.store or through a banner on our website. Your continued use of SPOX after any changes constitutes acceptance of the new Terms.

15. Entire Agreement & Contact Information
These Terms of Service, together with our Return & Refund Policy and Privacy Policy, constitute the entire agreement between you and SPOX regarding your purchase of used bags and cameras.
